INFORMATIVA SUL TRATTAMENTO DEI DATI PERSONALI AI SENSI DELL'ART. 13 DEL REGOLAMENTO (UE) 2016/679 DEL PARLAMENTO  EUROPEO E DEL CONSIGLIO DEL 27 APRILE 2016 ("REGOLAMENTO GENERALE SULLA PROTEZIONE DEI DATI")

PREMESSA:
La informativa che segue è redatta, ai sensi dell'art. 13 del Regolamento UE 2016/679 del Codice della Privacy, da Delta Software di David Castagnaro in relazione ai dati personali conferiti dagli utenti in occasione dell'accesso e/o della registrazione o della effettuazione di un acquisto sul sito deltasoftware.it (oppure "Sito"). Delta Software di David Castagnaro è titolare del Sito sul quale opera come erogatore del servizio di registrazione e di vendita.

1. Titolare del trattamento
Titolare del trattamento dei dati personali conferiti a deltasoftware.it è Delta Software di David Castagnaro con sede in Civitanova Marche (MC) Via Principe di Piemonte 36, P.IVA: 02077450431, e-mail: privacy@deltasoftware.it nella persona di David Castagnaro legale rappresentante.

2. Finalità del trattamento
deltasoftware.it tratterà i dati personali forniti dagli utenti per le seguenti finalità:
(a) per consentire la registrazione al Sito e di usufruire dei servizi riservati agli utenti registrati.

(b) per consentire di effettuare un acquisto online.
(c) per consentire la conclusione del contratto di acquisto e la corretta esecuzione delle operazioni connesse al medesimo incluse le attività di assistenza post-vendita.

Inoltre, gli utenti, anche se non registrati, potranno inviare richieste di informazioni o chiarimenti sui prodotti in vendita sul Sito e, per dare corso a tale richiesta, deltasoftware.it richiederà il conferimento di alcuni dati personali (es. nome, cognome e indirizzo e-mail);
(d) per finalità amministrativo-contabili nonché per adempiere a obblighi di legge;
(e) previo consenso espresso dell'utente, per l'invio di comunicazioni informative e promozionali (inclusa la "newsletter"), buoni sconto e offerte speciali nonché per lo svolgimento di ricerche di mercato, a mezzo di email e del servizio postale (c.d. finalità di "marketing").
(f) limitatamente alle coordinate di posta elettronica fornite dall'utente nel contesto dell'acquisto di un prodotto o di un servizio offerto, per consentire la vendita diretta di prodotti o servizi analoghi senza necessità del consenso espresso e preventivo dell'interessato (come previsto dall'art. 130, comma 4 del Codice della Privacy) e a condizione che l'utente non eserciti il diritto di opposizione nei modi descritti al punto 3 che segue (c.d. "soft spamming").
(g) previo consenso espresso dell'utente, per la elaborazione delle sue scelte di consumo e delle sue abitudini di acquisto da parte di deltasoftware.it attraverso la rilevazione della tipologia e della frequenza degli acquisti effettuati sul Sito, al fine dell'invio di materiale informativo e/o pubblicitario di specifico interesse dell'utente a mezzo di e-mail e del miglioramento delle proposte inviate dal sito (c.d. "profilazione").

Si precisa, inoltre, che:

Dati Sensibili
Per la registrazione al Sito e per effettuare un acquisto tramite il Sito non è mai richiesto il conferimento di dati sensibili.

All'utente potrebbe, invece, essere chiesto di fornire documentazione comprovante la sussistenza di una disabilità, e quindi il conferimento di dati sensibili, nel caso in cui egli intenda avvalersi dell'aliquota IVA agevolata in relazione all'acquisto di un prodotto che ammetta l'applicazione di tale regime, come previsto dalla Legge 28 febbraio 1997, n. 30.
I dati così conferiti verranno trattati dal sito al solo fine di consentire l’adempimento alle disposizioni della legge 28 febbraio 1997, n. 30 relativa all'applicazione dell'aliquota IVA agevolata.

Dati di navigazione
E' possibile accedere al Sito e visualizzare i prodotti offerti in vendita senza che sia richiesto il conferimento di alcun dato personale.

Tuttavia, i sistemi informatici e i software preposti al funzionamento del Sito acquisiscono, nel corso del loro normale esercizio, alcuni dati personali la cui trasmissione è implicita nell'uso dei protocolli di comunicazione di internet.

Tali informazioni non sono raccolte per essere associate a identificati, ma, per la loro stessa natura, potrebbero, attraverso elaborazioni o associazioni, permettere l'identificazione dell'utente.

In questa categoria rientrano gli indirizzi IP o i nomi a dominio dei computer utilizzati dagli utenti che accedono al Sito, gli indirizzi in notazione Url delle risorse richieste, l'orario della richiesta, il metodo utilizzato nel sottoporre la richiesta al server, la dimensione del file ottenuto in risposta, ecc.

Questi dati vengono utilizzati per ricavare informazioni statistiche anonime sull'uso del Sito (quale, in particolare, il numero di accessi) e per controllarne il corretto funzionamento.

In questo processo non è previsto il trattamento di informazioni direttamente identificative.

I dati di navigazione saranno acquisiti, con le modalità sopra indicate, solo da deltasoftware.it.

3. Conferimento dei dati e conseguenze in caso di mancato assenso al trattamento
Il conferimento dei dati per le finalità di cui alle lettere (a) (b) e (c) del punto 2 che precede è facoltativo.

Tuttavia, poiché tale trattamento è necessario per consentire la registrazione allo Sito e la prestazione dei servizi riservati, incluso il servizio di acquisto online, l'eventuale rifiuto di conferire i dati in questione comporterà l'impossibilità di registrarsi al Sito e/o di concludere un acquisto online.

Con riferimento alle finalità del trattamento di cui alle lettere (e) ("marketing") ed (g) ("profilazione") del punto 2 che precede, l'assenso al trattamento dei dati personali è meramente facoltativo e potrà essere manifestato attraverso la selezione di una apposita casella, per ciascuna distinta finalità, presente in calce al form di registrazione al Sito.

Il mancato assenso non comporterà alcuna conseguenza sulla possibilità di registrarsi al Sito e/o di effettuare acquisti sullo stesso e implicherà esclusivamente le conseguenze di seguito descritte: - il mancato assenso al trattamento dei dati personali per le finalità di cui al punto 2, lett. (e) ("marketing") che precede, comporterà l'impossibilità di ricevere comunicazioni informative e promozionali (inclusa la "newsletter"), buoni sconto e offerte speciali, da parte di deltasoftware.it, in relazione a prodotti e servizi, nonché per lo svolgimento di ricerche di mercato, a mezzo di email e del servizio postale; - il mancato assenso al trattamento dei dati personali per le finalità di cui al punto 2, lett. (g) ("profilazione") che precede comporterà l'impossibilità per deltasoftware.it di effettuare l'analisi delle scelte di consumo dell'utente attraverso la rilevazione della tipologia e della frequenza degli acquisti effettuati sul Sito al fine dell'invio di materiale informativo e/o pubblicitario di specifico interesse per l'utente.

L'utente potrà, in ogni caso, revocare il consenso eventualmente prestato per le finalità descritte alle lettere (e) ("marketing") ed (g) ("profilazione") del punto 2, ovvero opporsi al trattamento per le finalità di cui alla lettera (f) ("soft spamming") contattando deltasoftware.it all'indirizzo riportato al punto 1.

Inoltre, limitatamente alle finalità descritte alle lettere (e) ("marketing") ed (f) ("soft spamming") del punto 2 che precede, l'utente potrà opporsi al trattamento dei dati che lo riguardano anche tramite apposito link presente in calce a qualsiasi e-mail a contenuto promozionale inviata da deltasoftware.it.

L'opposizione manifestata con tali modalità si estende anche all'invio di comunicazioni mediante il servizio postale.

4. Modalità del trattamento dei dati
Il trattamento dei dati sarà principalmente effettuato con l'ausilio di strumenti elettronici o comunque automatizzati, secondo le modalità e con mezzi idonei a garantire la sicurezza e la riservatezza dei dati stessi, in conformità di quanto previsto dal Codice della Privacy.

In particolare, saranno adottate tutte le misure tecniche, informatiche, organizzative, logistiche e procedurali di sicurezza, in modo che sia garantito il livello minimo di protezione dei dati previsto dalla legge, consentendo l'accesso alle sole persone incaricate del trattamento da parte del Titolare o dei responsabili dallo stesso designati.

5. Ambito di comunicazione dei dati
I dati personali conferiti dall'utente, per le finalità descritte al punto 2 che precede, potranno essere portati a conoscenza di o comunicati ai seguenti soggetti:
(i) dipendenti o collaboratori di deltasoftware.it per lo svolgimento di attività di amministrazione, contabilità e supporto informatico e logistico che agiscono in qualità, rispettivamente, di responsabili e incaricati del trattamento;
(ii) a società incaricate da deltasoftware.it dell'invio di comunicazioni online;
(iii) ai soggetti preposti alla riparazione dei prodotti acquistati in esecuzione della garanzia legale di conformità;

(iv) a tutti quei soggetti pubblici e/o privati, persone fisiche e/o giuridiche (studi di consulenza legale, amministrativa e fiscale), qualora la comunicazione risulti necessaria o funzionale al corretto adempimento degli obblighi contrattuali assunti in relazione ai servizi prestati tramite il Sito, nonché' degli obblighi derivanti dalla legge a spedizionieri e ai soggetti incaricati della consegna e/o del ritiro dei prodotti acquistati;

(v) a tutti quei soggetti (ivi incluse le Pubbliche Autorità) che hanno accesso ai dati in forza di provvedimenti normativi o amministrativi;

Tutti i dati personali conferiti dagli utenti in relazione alla registrazione al Sito e/o all'acquisto tramite il Sito non sono soggetti a diffusione.
L'elenco aggiornato dei responsabili e degli incaricati del trattamento è consultabile presso la sede dei Titolari.

6. Conservazione dei dati
I dati personali saranno conservati per il solo tempo necessario a garantire la corretta prestazione dei servizi offerti.

Nel caso di chiusura dell'account del Sito su iniziativa dell'utente, i dati in esso riportati saranno conservati per finalità amministrative per un periodo non superiore a un trimestre, fatti salvi eventuali specifici obblighi di legge sulla conservazione di documentazione contabile o per finalità di pubblica sicurezza.

In ogni caso, resta inteso che i dati personali saranno conservati e trattati per le finalità di cui alle lettere (e) "marketing" e (g) "profilazione", di cui al punto 2 che precede, per il periodo di tempo consentito dalla legge e dalle prescrizioni del Garante per la Protezione dei Dati Personali.

Al termine di tale periodo deltasoftware.it potrà chiedere all'utente di rinnovare il consenso al trattamento dei suoi dati per tali finalità o rendere gli stessi in forma anonima e conservarli solamente per fini statistici.

7. Diritti dell’interessato
La normativa attribuisce specifici diritti all'interessato il quale, per l'esercizio di tali diritti, può rivolgersi direttamente al titolare del trattamento.

L'interessato può esercitare i suoi diritti (artt. 15-22 GDPR) anche in un momento successivo a quello in cui ha prestato il consenso, potendo così revocare un consenso già prestato.
I diritti esercitabili dall'interessato sono:
1) diritto di ottenere informazioni su quali dati sono trattati dal titolare (diritto di informazione);

2) diritto di chiedere ed ottenere in forma intellegibile i dati in possesso del titolare (diritto di accesso);
3) diritto di ottenere l'aggiornamento o la rettifica dei dati conferiti;
4) diritto di ottenere la cancellazione dei dati in possesso del titolare;
5) esercitare l'opposizione al trattamento in tutto o in parte;
6) diritto di revocare il consenso in qualsiasi momento;
7) diritto di opporsi ai trattamenti automatizzati e a non essere assoggettati a trattamenti basati esclusivamente su decisioni automatizzate compreso la profilazione;
8) diritto di chiedere ed ottenere trasformazione in forma anonima dei dati;
9) diritto di chiedere ed ottenere il blocco o la limitazione dei dati trattati in violazione di legge e quelli dei quali non è più necessaria la conservazione in relazione agli scopi del trattamento;
10) diritto alla portabilità dei dati.
I diritti di cui sopra potranno essere esercitati con richiesta al Titolare, ai recapiti riportati al punto 1 della presente informativa.

INFORMATION ON THE PROCESSING OF PERSONAL DATA IN ACCORDANCE WITH ARTICLE 13 OF REGULATION (EU) 2016/679 OF THE EUROPEAN PARLIAMENT AND COUNCIL OF 27 APRIL 2016 ("GENERAL REGULATION ON DATA PROTECTION").

FOREWORD:
The following information is prepared, pursuant to Article 13 of the EU Regulation 2016/679 of the Privacy Code, by Delta Software di David Castagnaro in relation to personal data provided by users when accessing and/or registering or making a purchase on the deltasoftware.it site (or "Site"). Delta Software di David Castagnaro is the owner of the Site on which it operates as a provider of the registration and sales service.

1. Owner of processing
The owner of the processing of personal data conferred to deltasoftware.it is Delta Software di David Castagnaro with registered office in Civitanova Marche (MC) Via Principe di Piemonte 36, VAT#: 02077450431, e-mail: privacy@deltasoftware.it in the person of David Castagnaro legal representative.

2. Purpose of processing
deltasoftware.it will process personal data provided by users for the following purposes:
(a) to enable registration on the Site and to take advantage of services reserved for registered users.

(b) to enable you to make an online purchase.
(c) to enable the conclusion of the purchase contract and the proper execution of transactions related to it including after-sales service activities.

In addition, users, even if they are not registered, may send requests for information or clarification on products for sale on the Site and, in order to execute such a request, deltasoftware.it will require the provision of certain personal data (e.g., first name, last name and e-mail address);
(d) for administrative-accounting purposes as well as to fulfill legal obligations;
(e) with the express consent of the user, for sending informative and promotional communications (including the "newsletter"), coupons and special offers as well as for conducting market research, by means of email and postal service (so-called "marketing" purposes).
(f) limited to e-mail coordinates provided by the user in the context of the purchase of a product or service offered, in order to enable direct sales of similar products or services without the need for the express and prior consent of the data subject (as provided for in Article 130, paragraph 4 of the Privacy Code) and provided that the user does not exercise the right to object in the manner described in Section 3 below (so-called "soft spamming").
(g) with the express consent of the user, for the processing of his/her consumption choices and purchasing habits by deltasoftware.it through the detection of the type and frequency of purchases made on the Site, in order to send informative and/or advertising material of specific interest to the user by e-mail and the improvement of the proposals sent by the Site (so-called "profiling").

It is also pointed out that:

Sensitive Data
Registration on the Site and making a purchase through the Site is never required to provide sensitive data.

The user may, on the other hand, be asked to provide documentation proving the existence of a disability, and therefore the provision of sensitive data, in the event that he/she intends to avail himself/herself of the subsidized VAT rate in relation to the purchase of a product that admits the application of this regime, as provided for by Law 28 February 1997, No. 30.
The data thus conferred will be processed by the site for the sole purpose of enabling compliance with the provisions of Law 28 February 1997, No. 30 relating to the application of the subsidized VAT rate.

Navigation data
It is possible to access the Site and view products offered for sale without being required to provide any personal information.

However, the computer systems and software used to operate the Site acquire, in the course of their normal operation, some personal data whose transmission is implicit in the use of Internet communication protocols.

This information is not collected in order to be associated with identified, but, by its very nature, could, through processing or association, allow the user to be identified.

This category includes IP addresses or domain names of computers used by users accessing the Site, Url notation addresses of requested resources, the time of the request, the method used in submitting the request to the server, the size of the file obtained in response, etc.

This data is used to obtain anonymous statistical information about the use of the Site (such as, in particular, the number of accesses) and to monitor its proper functioning.

No directly identifying information is to be processed in this process.

Browsing data will be acquired, in the manner stated above, only by deltasoftware.it.

3. Provision of data and consequences if consent to processing is not given
The provision of data for the purposes in (a) (b) and (c) of 2 above is optional.

However, since such processing is necessary to enable registration with the Site and the provision of the reserved services, including the online purchasing service, any refusal to provide such data will result in the inability to register with the Site and/or complete an online purchase.

With reference to the purposes of the processing referred to in points (e) ("marketing") and (g) ("profiling") of point 2 above, consent to the processing of personal data is merely optional and may be expressed by checking the appropriate box, for each distinct purpose, at the bottom of the Site registration form.

The lack of consent will not entail any consequence on the possibility of registering to the Site and/or making purchases on the same and will entail only the consequences described below: - failure to consent to the processing of personal data for the purposes referred to in point 2, lett. (e) ("marketing") above, will result in the impossibility to receive informative and promotional communications (including the "newsletter"), coupons and special offers, from deltasoftware.it, in relation to products and services, as well as for the conduct of market research, by email and postal service; - failure to consent to the processing of personal data for the purposes referred to in point 2, lett. (g) ("profiling") above will result in the impossibility for deltasoftware.it to carry out the analysis of the user's consumption choices through the detection of the type and frequency of purchases made on the Site for the purpose of sending informative and/or advertising material of specific interest to the user.

The user may, in any case, revoke any consent given for the purposes described in points (e) ("marketing") and (g) ("profiling") of point 2, or object to processing for the purposes described in point (f) ("soft spamming") by contacting deltasoftware.it at the address given in point 1.

In addition, limited to the purposes described in (e) ("marketing") and (f) ("soft spamming") of point 2 above, the user may also object to the processing of data about him or her via a special link at the bottom of any e-mail with promotional content sent by deltasoftware.it.

Opposition expressed in this manner also extends to the sending of communications by postal service.

4. Methods of data processing
The processing of data will be mainly carried out with the help of electronic or otherwise automated tools, in the manner and by appropriate means to ensure the security and confidentiality of the data, in accordance with the provisions of the Privacy Code.

In particular, all technical, IT, organizational, logistical and procedural security measures will be taken so that the minimum level of data protection required by law will be guaranteed, allowing access only to the persons in charge of the processing by the Data Controller or the persons in charge designated by the same.

5. Scope of data reporting
Personal data provided by the user, for the purposes described in section 2 above, may be brought to the attention of or communicated to the following parties:
(i) employees or collaborators of deltasoftware.it for the performance of administration, accounting, and IT and logistical support who act as data controllers and data processors, respectively;
(ii) to companies contracted by deltasoftware.it to send online communications;
(iii) to the parties responsible for repairing the products purchased in execution of the legal warranty of conformity;

(iv) to all those public and / or private individuals and / or legal entities (legal, administrative and tax consulting firms), if the communication is necessary or functional for the proper fulfillment of contractual obligations assumed in relation to the services provided through the Site, as well as' the obligations arising from the law to shippers and those charged with the delivery and / or collection of products purchased;

(v) to all those entities (including Public Authorities) that have access to the data by virtue of regulatory or administrative measures;

All personal data provided by users in connection with registration on the Site and/or purchase through the Site are not subject to dissemination.
The updated list of data controllers and processors can be consulted at the office of the Data Controllers.

6. Data retention
Personal data will be kept only as long as necessary to ensure the proper provision of the services offered.

In the event that the Site account is closed at the user's initiative, the data in it will be retained for administrative purposes for a period not exceeding one quarter, subject to any specific legal requirements on the retention of accounting records or for public safety purposes.

In any case, it is understood that personal data will be retained and processed for the purposes of (e) "marketing" and (g) "profiling," referred to in point 2 above, for the period of time permitted by law and the requirements of the Data Protection Authority.

At the end of this period deltasoftware.it may ask the user to renew consent to the processing of his or her data for these purposes or make it anonymous and retain it for statistical purposes only.

7. Rights of the interested party
The legislation gives specific rights to the data subject who, in order to exercise these rights, may apply directly to the data controller.

The data subject can also exercise his or her rights (Articles 15-22 GDPR) at a time after he or she has given consent, thus being able to revoke a consent already given.
The rights that can be exercised by the data subject are:
1) right to obtain information about what data are processed by the data controller (right to information);

2) Right to request and obtain in intelligible form data held by the owner (right of access);
3) Right to obtain the updating or rectification of the data provided;
4) Right to obtain the deletion of data held by the owner;
5) Exercise opposition to processing in whole or in part;
6) Right to withdraw consent at any time;
7) Right to object to automated processing and not to be subjected to processing based solely on automated decisions including profiling;
8) Right to request and obtain transformation of data into anonymous form;
9) Right to request and obtain the blocking or restriction of data processed in violation of the law and those whose storage is no longer necessary in relation to the purposes of processing;
10) right to data portability.
The above rights may be exercised by making a request to the Data Controller, at the contact details given in section 1 of this policy.
